The Guidelines for Collection Agency Virginia to Follow

By Rob Sutter

It seems easier to dismiss debt agencies based on stories one has heard rather than commend them on the jobs they do. Working off of commission, every case is treated with care in order to see the most optimal results imaginable. Getting there isn't easy, though, and that is thanks to the rules they have to follow and are required to meet in every situation. A collection agency Virginia would, without question, find that the challenge is often worth the reward in the end.

Along with other debt agencies, a collection agency Virginia should be able to respect the personal space that a debtor is entitled to. For example, my uncle once had a collector contact him so many times that it was until 12:30 AM that said collector finally left him alone. This is against the law since a collector may contact a person between 8 AM to 9 PM only. Companies that are morally sound like R.R.S. recognize these kinds of rules and follow them to a tee.

Unacceptable forms of communication are also shown under the Fair Debt Collection Practices Act and each one is against said act. A postcard being sent to a debtor is not allowed. This isn't quite as dire as threatening a debtor, saying that he or she will be arrested if money is not collected. No collector has the authority to do such a thing, so it's a boldfaced lie on top of a threat.

Also forbidden by the FDCPA is the act of false representation, which can take on a litany of shapes. For example, the status and amount of the debt in question must be entirely truthful, lest a collector be considered a felon. Not every collector will go down his path, though, since honest ones would rather not resort to making threatening statements to people. The number of honest collectors is still quite high but the others will not think twice about bending, if not breaking, a rule that was set in stone.

As one can see, collectors have a number of rules to follow and it might be hard to keep track of them all. I am not an authority on the business, so perhaps it's difficult for me to see things in the way that collectors can. However, what I can't condone is a business going about immoral practices in order to conduct business faster yet immorally. Hopefully the rules that have been set in place won't be broken anytime soon, since I can only see said rules becoming more cemented from this point.
