The Limits of Where Debt Collector Services Should Go

By Rob Sutter

Debt collector services are put to use so that a client is given the money owed by the debtor. The process in general is one that is highly intricate and it is done through the efforts of three parties: the debtor, the client, and, of course, the collector. Even though most companies will follow the rules reasonably well, not every company is high on the rules. In fact, guidelines have been placed so that no collection agency can act unlawfully without consequences.

Companies like R.R.S. do fine work in the collection industry and it's something that other organizations should follow. Debt collector services have a set form of guidelines to adhere to and many of them can be found within the Fair Debt Collection Practices Act. For those not in the know, the FDCPA tells all of the rules that a collector should follow when securing payment. On the other side of the coin, it gives the debtor more knowledge on his or her rights.

It is very much against the rules for a collector to utilize vulgar or crude gestures in order to collect a debt. There's no excuse for a worker approaching a debtor with threats and curses, endangering not only the personal safety of that person but the respect he or she has. Threats can also come in the form of lies. For example, if a collector says the debtor can face arrest if the amount isn't paid off, then it's a lie because no one in such an agency has the power to do that.

I feel like if an agency had nothing short of a reputable standing, then there wouldn't be as much concern about the law. I feel like, if anything, the debtor would be confident going into this financial situation. A good portion of my gripes seem to be in how a debtor can be at times. Yes, there are agencies out there which act in immoral ways but I'd be lying if I said that there weren't a few bad eggs out there that weren't paying up.

Why is that collectors receive most of the bad press online while debtors apparently get away unscathed? It's not like collectors want to pursue these people; they're tasked to do a job and if a client has a case, then it's up to the collector to seize the funds that are owed. When a debtor simply ignores the calls and pleas or is too scared to respond, the problems can only mount. Ignoring debts out of fear is not the way to handle a situation because legal troubles can only worsen if it were the case.
